Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PowerSpeak mobile application, website, and related services (collectively, the "Service") operated by Enabled HR Labs Inc. ("we," "our," or "us").

By downloading, installing, or using PowerSpeak, you agree to be bound by these Terms. If you are setting up the Service on behalf of another person, such as a child, patient, or client, you confirm that you have the legal authority to agree to these Terms on their behalf.

If you do not agree to these Terms, do not use the Service.

1. Eligibility and Account Responsibility

The Service is intended for use by individuals of any age with the support of a caregiver, parent, SLP, or institutional administrator where appropriate.

If you are creating an account, you must provide accurate and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Caregivers, SLPs, and institutional administrators who create profiles on behalf of others confirm they have the appropriate authority, consent, or legal authorization to do so.

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the Service or other users.

2. Permitted Use

PowerSpeak is an augmentative and alternative communication (AAC) tool designed to support individuals with autism, ALS, speech delays, acquired communication disabilities, and related conditions.

You agree to use the Service only for its intended purpose and in compliance with these Terms and all applicable laws. You must not:

Use the Service in any way that violates applicable Canadian, U.S., or other applicable law or regulation

Attempt to gain unauthorized access to any part of the Service or its underlying systems

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App

Use the Service to transmit harmful, abusive, harassing, or unlawful content

Introduce malware, viruses, or any other harmful code

Collect or harvest data from the Service without our express written permission

3. Not a Medical Device or Clinical Service

PowerSpeak is a communication support tool. It is not a medical device, regulated health product, or clinical therapy service under Canadian or U.S. law.

PowerSpeak does not diagnose, treat, cure, or prevent any medical condition. Use of the App does not create a clinical relationship between you and Enabled HR Labs Inc.

The App is designed to complement, not replace, professional speech-language pathology services. Users are encouraged to work with qualified SLPs and healthcare professionals for clinical guidance.

4. Free Access

PowerSpeak is free to download and use. We do not charge users for access to the App. There are no paid subscriptions, in-app purchases, or premium tiers at this time.

We reserve the right to introduce paid features in the future. If we do, we will update these Terms and provide clear notice before any charges apply. You will never be charged without your explicit consent.

5. Intellectual Property

All content in the Service, including but not limited to the software, symbols, interface designs, text, graphics, and documentation, is the property of Enabled HR Labs Inc. or its licensors and is protected by applicable copyright, trademark, and intellectual property laws in Canada and internationally.

You may not reproduce, distribute, modify, display, publish, sublicense, or create derivative works from any part of the Service without our prior written permission.

User-created content such as custom symbol sets, vocabulary boards, and communication profiles remains your property. By creating this content within the App, you grant us a limited, non-exclusive, royalty-free license to store, process, and display it solely for the purpose of providing the Service to you. This license ends when you delete your account or the content.

6. Accuracy of Information

We make reasonable efforts to ensure that information in the Service is accurate and current. We do not warrant that content is free from errors, inaccuracies, or omissions. We reserve the right to correct any errors and update information at any time without notice.

7. Third-Party Services

The Service integrates with or links to third-party services including the Apple App Store and cloud infrastructure providers. We are not responsible for the content, availability, or practices of third-party services.

Your use of third-party services is governed by those services' own terms and privacy policies. We encourage you to review them.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not warrant any particular outcome from use of the App.

Nothing in this clause limits any statutory rights you may have under applicable Canadian consumer protection laws that cannot be waived by contract.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ENABLED HR LABS INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim arising under these Terms or from your use of the Service shall not exceed $100 CAD.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Enabled HR Labs Inc. and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our discretion.

You may stop using the Service at any time. To close your account and request deletion of your data, contact us at jeby@enabledtalent.com.

Sections 5 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), and 13 (Dispute Resolution) survive termination of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.

To the extent that users are located in the United States and COPPA or other applicable U.S. laws impose specific obligations, we comply with those obligations as described in our Privacy Policy.

13. Dispute Resolution

We encourage you to contact us first at jeby@enabledtalent.com to resolve any dispute informally. We will make reasonable efforts to resolve disputes through direct communication.

If a dispute cannot be resolved informally, it shall be submitted to the courts of Ontario, Canada, and you consent to the jurisdiction of those courts, except where applicable law requires otherwise.

Nothing in this section limits your right to file a complaint with a regulatory authority such as the Office of the Privacy Commissioner of Canada.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms at www.powerspeak.app with a revised effective date. For material changes, we will provide notice through the App or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
